When you access our Services, we automatically collect certain telemetry data:

• Log Data: IP address, browser type, operating system, referral URLs, device information, and timestamps.
• Usage Data: API request volume, error rates, endpoint usage frequency, and performance metrics associated with your API keys.

3. How We Use Your Information

We use the collected information for the following purposes:

• To provide, maintain, and improve the Nexusify Intelligence Layer and free API services.
• To manage your account, authenticate API requests, and track compute unit usage.
• To monitor and analyze trends, usage, and activities in connection with our Services.
• To detect, investigate, and prevent abuse, fraud, and other illegal activities.
• To communicate with you about service updates, security alerts, and support messages.

4. API Content & Model Training

API Content: This refers to the data you send to our API (inputs/prompts) and the data you receive (outputs/completions).

No Training on API Content: By default, Nexusify does not use your API Content to train our foundational models. Your inputs remain yours, and your outputs are assigned to you.

We may only access API Content in the following limited circumstances:

• To resolve specific technical support incidents at your request.
• To investigate and prevent violations of our Terms of Service (e.g., generation of CSAM, malware, or spam).
• To comply with valid legal processes.

5. Disclosure of Data

We may share your information in the following situations:

• Vendors and Service Providers: We share information with third-party vendors who help us operate our Services (e.g., cloud hosting providers, email delivery services) and who are bound by confidentiality obligations.
• Legal Requirements: We may disclose information if we believe disclosure is in accordance with, or required by, any applicable law, regulation, or legal process.

6. Data Security

We employ industry-standard technical and organizational measures to protect your data, including encryption in transit (TLS 1.2+) and at rest (AES-256). However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.

API Keys are sensitive credentials. You are responsible for keeping them confidential. Nexusify will never ask for your API keys via email.

We retain your personal information and usage logs for as long as your account is active or as needed to provide you the Services. We may retain specific data for longer periods if necessary to comply with our legal obligations, resolve disputes, or enforce our agreements.

API Content is generally retained only for a short period necessary to process the request and perform safety monitoring (typically less than 30 days), unless legally required otherwise.

8. International Transfers

Nexusify operates globally. Your information may be transferred to, stored, and processed in countries other than your own, including the United States, where data protection laws may differ from those of your jurisdiction. By using our Services, you consent to such transfers.
